MAHA Membership Terms & Conditions
By purchasing, joining, accessing or renewing the MAHA Membership, you agree to these Membership Terms, the Wellbeing & Safety Policy and the Privacy Policy. Please read them before subscribing.
1. Parties and membership. You must be at least 18 years old and legally capable of entering this agreement. Membership is personal, non-transferable and for individual use only. The Membership may include the MAHA Vault, short on-demand practices, an app or member portal, community access, live group sessions, replays, calendars and other inclusions described on the checkout page at the time you subscribe. Inclusions may evolve under clause 10.
2. Nature and scope MAHA provides education, personal development, spiritual exploration, yoga-inspired practices, breathwork, meditation, mantra, somatic practices and general wellbeing support. The Membership is not medical or mental health care and does not create a practitioner-patient, therapist-client, fiduciary or similar professional relationship. No particular result is promised. Your experience depends on factors including your circumstances, participation, choices and implementation. Testimonials illustrate individual experiences only.
3. Subscription, billing and renewal
Unless the checkout page clearly states otherwise, the Membership is a recurring monthly subscription billed in advance in Australian dollars. It renews automatically on each billing date until cancelled. The recurring price, billing frequency and any trial or introductory period will be shown before purchase.
You authorise MAHA and its payment provider to charge the selected payment method for recurring fees and applicable taxes. You must keep billing details current. If payment fails, we may retry the charge and temporarily suspend access after reasonable notice while the amount remains unpaid. Late payments. Payments not received by the due date may result in temporary suspension of your Membership. 48 hour notice, an administrative late fee of AUD $20 per week may be charged until the overdue amount is cleared, but only to the extent that the fee is reasonable, reflects MAHA's administrative costs and is permitted by law. Default.
If an amount remains overdue for more than 30 days, MAHA may refer the debt to a collection agency after giving written notice and a reasonable opportunity to pay or contact us about a genuine billing dispute or hardship. You may be responsible for reasonable recovery costs, legal fees and collection charges actually incurred, but only to the extent those amounts are lawfully recoverable.
4. Cancellation
You may cancel at any time through the cancellation method displayed in your account or by emailing [email protected]. Cancellation takes effect at the end of the current paid billing period unless we confirm an earlier date. You retain access until then and no further recurring fee will be charged, provided the request is received before the next billing charge is processed. There is no minimum commitment unless a distinct offer clearly discloses one before purchase. Rejoining is subject to the price, inclusions and availability applying at that time.
5. Refunds and consumer rights
All sales are final. No refunds or credits are provided once a purchase has been completed for change of mind, non-participation or unused access. However, nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or another law that cannot lawfully be excluded. Where a service fails to meet a non-excludable consumer guarantee, you may be entitled to a remedy including re-supply, cancellation, refund or compensation depending on the circumstances. If we cancel the Membership other than for your material breach, we will provide a pro-rata refund for the unused portion of any prepaid period, unless we provide a substantially equivalent alternative accepted by you.
6. Access and technology
Access begins after successful payment and account activation. You are responsible for compatible devices, internet access and safeguarding your login details. Tell us promptly of suspected unauthorised use. We may use third-party platforms and cannot promise uninterrupted or error-free operation, but will use reasonable care to provide the service and address material faults. Do not share credentials, bypass access controls, scrape content, introduce malicious code, or use the service in a way that disrupts another person. We may suspend access where reasonably necessary for security, maintenance, legal compliance or investigation, and will minimise disruption where practicable.
7. Live sessions, recordings and replays
Live session dates, facilitators and formats may change. If MAHA cancels or materially reschedules a live session, a replay, substitute session or other reasonable alternative may be offered. Missed sessions do not create an entitlement to a refund where the remaining Membership is supplied as described. MAHA may record live sessions for member replays only after notifying participants. You may keep your camera off and avoid sharing identifying information. If you speak or appear on camera, your contribution may form part of the recording. Contact us before the session if you require clarification. You must not record, screenshot or distribute a session or another participant's contribution without prior written consent. 8. Community conduct and confidentiality
You agree to communicate respectfully, protect others' privacy and avoid harassment, discrimination, bullying, threats, spam, promotion without permission, unlawful conduct, or presenting professional advice outside your qualifications. Community confidentiality is expected, but MAHA cannot guarantee that another participant will maintain it; share thoughtfully. We may moderate content or restrict participation where reasonably necessary for safety or compliance. For a serious or repeated breach, we may suspend or terminate access after considering the nature of the conduct and, where appropriate, giving notice and an opportunity to respond. Immediate action may be taken where there is a credible safety, privacy, security or legal risk.
9. Intellectual property
MAHA or its licensors own all rights in the Membership content, including videos, recordings, meditations, practices, frameworks, text, graphics, branding and downloads. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use content personally during your paid access period. Downloads expressly marked for ongoing personal use may be retained, but not shared or commercialised. • Do not copy, reproduce, publish, distribute, sell, sublicense or create commercial derivative products from Membership content. • Do not share portal access or use materials to teach, train, treat or advise others without a separate written licence. • You retain ownership of material you submit. You grant MAHA only the permissions reasonably required to host, display and administer it within the service.
10. Reasonable changes to the Membership
We may make reasonable changes to content, scheduling, facilitators, platforms or features to improve, secure or operate the Membership. We will not remove the core paid service or make a materially adverse change during a prepaid period without reasonable notice and an appropriate remedy. Material changes to these terms will be notified before they take effect; continued use after the effective date indicates acceptance, but does not waive non-excludable rights.
11. Suspension and termination
You may terminate by cancelling under clause 4. We may suspend or terminate for material non-payment, material breach, unlawful use, credible safety risk or misuse of intellectual property. Where reasonably possible, we will identify the issue and allow a reasonable opportunity to remedy it. Termination does not affect accrued rights, confidentiality, intellectual property restrictions or clauses intended to survive.
12. Liability
To the extent permitted by law, MAHA is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by your failure to follow safety guidance, your undisclosed health circumstances, third-party conduct outside MAHA's reasonable control, or events beyond reasonable control. Nothing limits liability that cannot lawfully be limited, including applicable consumer guarantees. MAHA Collective | Legal & Wellbeing Policy Suite | Working draft 6 Where the law permits a remedy to be limited, MAHA may elect to re-supply the relevant services or pay the reasonable cost of re-supply. Any monetary cap stated in these terms does not apply where unlawful or where loss results from fraud, wilful misconduct, or liability that cannot be capped.
13. Communications, complaints and disputes
Service notices may be sent to the email linked to your account. Marketing messages are optional and may be unsubscribed from without affecting essential service communications. Send complaints to [email protected] with relevant details. We will acknowledge and seek to resolve them fairly. Before court proceedings, each party agrees to attempt good-faith informal resolution, unless urgent relief is required.
14. Governing law
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts with jurisdiction in Victoria, subject to any right you have under mandatory consumer law to bring proceedings elsewhere.
Wellbeing & Safety Policy
This policy applies to all MAHA programs, memberships, sessions, events, practices, community spaces and digital content. Its purpose is to support informed, self-directed participation and clear professional boundaries.
1. What MAHA is - and is not MAHA offers general wellbeing education and practices. It is not a medical, psychology, psychiatry, counselling, physiotherapy, dietetic, emergency, crisis or diagnostic service. Facilitators do not diagnose conditions, prescribe treatment or advise you to stop professional care or medication. Spiritual language is invitational and must not be treated as a factual diagnosis or substitute for evidence-based care.
2. Your responsibility before participating Choose practices appropriate to your body, health, experience and environment. Consult a qualified health practitioner before participating if you are pregnant or postpartum; have cardiovascular, respiratory, neurological, musculoskeletal or eye conditions; have a history of fainting, seizures, recent surgery or injury; live with a diagnosed or suspected mental health condition; take medication that may affect participation; or are unsure whether a practice is suitable. Do not participate while driving, in water, under the influence of alcohol or drugs, or where closing your eyes, altered breathing or movement would be unsafe. Use a stable, private environment and stop immediately if you experience pain, dizziness, numbness, faintness, panic, unusual shortness of breath, chest pain, disorientation or distress.
3. Breathwork, movement, meditation and energy practices Practices may create physical sensations or bring emotions and memories into awareness. Never force or strain. Keep breathing comfortable; return to normal breathing whenever needed. Modify or skip movement. Keep eyes open, orient to the room, feel your feet, pause the recording or leave a live session at any time. Practices involving breath retention, rapid breathing, strong abdominal action, inversions or vigorous movement require particular caution and should only be undertaken when expressly guided and appropriate for you.
4. Trauma-aware choice and consent Participation is voluntary. You may decline a prompt, keep your camera off, refrain from sharing, or leave without explanation. MAHA aims to use choice-based language and avoid pressure to disclose personal experiences. Group spaces are not suitable for processing acute trauma or receiving individual clinical care. You decide what to share and should avoid revealing another person's private information. MAHA Collective | Legal & Wellbeing Policy Suite | Working draft 8
5. Mental health, crisis and emergency support MAHA is not monitored as a crisis service. If you are in immediate danger or believe you may harm yourself or another person, call emergency services in your location immediately. In Australia, call 000. For 24/7 crisis support in Australia, contact Lifeline on 13 11 14. If outside Australia, use your local emergency or crisis service. Do not wait for a reply from MAHA. If a facilitator reasonably believes there is a serious and imminent safety concern, MAHA may encourage professional support, pause participation, contact an emergency service or nominated emergency contact where lawful and reasonably necessary, and document the steps taken. Confidentiality may be limited where disclosure is required or authorised by law or necessary to address a serious threat.
6. Facilitator boundaries
• Facilitators work only within their stated training and scope. • No guarantee is made that a practice is suitable for every participant. • One-to-one clinical advice will not be provided through community channels. • MAHA may recommend pausing a practice or obtaining clearance from a qualified practitioner. • Professional, financial, romantic or sexual exploitation of participants is prohibited.
7. Community care
Members should respond to another person's disclosure with respect, avoid diagnosing or prescribing, and direct urgent concerns to qualified services. Do not promise secrecy where there is an immediate safety risk. Report concerning behaviour privately to [email protected].
8. Incidents, feedback and review
Report injuries, adverse reactions, privacy concerns or conduct issues as soon as practicable. Include the date, session and a factual description. MAHA will respond proportionately, keep records securely, and may modify content, facilitator guidance or access arrangements. This policy is reviewed periodically and after a material incident.
Privacy Policy
